Terms of Service

Plain-language summary: Speak is a free AAC communication app. You can use it without an account. If you create an account, you agree to these terms. The app is provided as-is — we do our best but cannot guarantee it will always work perfectly. The private safety channel is a supplement to, not a replacement for, emergency services. Always call 911 in an immediate emergency.

By using Speak, you agree to these terms. If you are setting up Speak for a child under 13, you — the parent or guardian — are the account holder and agree on their behalf.

1. Who we are

Speak AAC is operated by Speak AAC LLC, a Kansas company. Contact us at support@speakaac.org.

2. Who can use Speak

You must be at least 13 years old to create a Speak account. If you are setting up Speak for a child under 13, a parent or guardian must create and control the account. By creating an account, you confirm that you are 13 or older, or that you are a parent or guardian acting on behalf of a minor.

Speak is intended to be used by or on behalf of individuals who benefit from augmentative and alternative communication (AAC) tools. Use of the app for any purpose that harms, exploits, or misrepresents AAC users or children is strictly prohibited.

3. Prohibited uses

You may not use Speak to:

Speak is a communication tool. We are not responsible for the content users choose to communicate through it. However, we reserve the right to suspend or terminate access for any account we determine is being used in violation of these terms or in a way that could harm others.

4. The service

Speak provides a browser-based AAC communication application including symbol grids, recorded audio output, AI-assisted sentence construction, a private safety channel, and optional cloud sync of settings and communication history. Core features are free. Cloud sync and AI sentence construction require a paid subscription.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice for material changes.

5. The private safety channel — important limitations

The private safety channel is not a substitute for emergency services.

If you or a child is in immediate danger, call 911 first. Do not rely solely on the safety channel in a crisis.

The private safety channel sends an email notification to a trusted contact you configure. It depends on several factors outside our control: internet connectivity, the availability of our email delivery provider (EmailJS), whether the trusted contact checks their email promptly, and the accuracy of the contact information you entered.

Speak makes no guarantee that safety alerts will be delivered or acted upon within any specific timeframe. The safety channel is a supplement to — not a replacement for — direct emergency services, 911, child protective services, or other professional crisis resources.

We are not liable for any harm that results from a failure of the safety channel to deliver an alert or from a trusted contact's failure to respond.

6. Accounts and subscriptions

You are responsible for maintaining the security of your account credentials. Do not share your Provider PIN or account password with anyone you do not trust with full access to the account.

Paid subscriptions are billed monthly through Stripe. You may cancel at any time from your account settings or by emailing support@speakaac.org. Cancellation stops future charges; we do not provide refunds for the current billing period except where required by law.

We reserve the right to suspend or terminate accounts that violate these terms, misuse the safety channel, or are used for any purpose that could harm children or other users.

7. HIPAA — clinic and institution plans

If you are a healthcare provider, speech-language pathologist, therapist, or clinic using Speak in a professional capacity to support clients, you may be subject to HIPAA requirements. A Business Associate Agreement (BAA) is available upon request for Clinic and Institution plan subscribers. Email support@speakaac.org with the subject line "BAA Request" and we will provide one within 5 business days.

Do not use Speak to store or transmit protected health information (PHI) on a Clinic or Institution plan without a signed BAA in place.

8. FERPA — school and institution use

If you are a school or school district using Speak, student communication logs stored under educator accounts may be subject to FERPA. By using an Institution plan, you agree to use Speak only in accordance with applicable FERPA requirements. A data processing agreement for school use is available upon request.

9. Intellectual property

The Speak application, its code, design, branding, and original content are owned by Speak AAC LLC. All rights reserved. You may not copy, reproduce, modify, or distribute any part of the application without written permission.

Mulberry Symbols are © Garry Pye and are used under Creative Commons BY-SA 4.0. Custom symbols you upload remain your property and are stored only on your device.

10. Disclaimer of warranties

Speak is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free from security vulnerabilities. We do not warrant that the AI sentence builder will always produce accurate or appropriate output.

11. Limitation of liability

To the fullest extent permitted by law, Speak AAC LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, personal injury, or harm arising from reliance on the safety channel — even if advised of the possibility of such damages.

Our total liability to you for any claim arising from your use of Speak shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.

12. Privacy

Your use of Speak is also governed by our Privacy Policy, which is incorporated into these terms by reference.

13. Changes to these terms

We may update these terms from time to time. Material changes will be communicated to account holders by email at least 14 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of the State of Kansas, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kansas.
